The assumption that "hip hop culture" only means certain things seems silly. Is the writer's head totally buried in mainstream, conservative media?

I love your icon (love rivers) also checked your music interests and think you might like a dvd I just rented from Blockbuster called "Touch the Sound" with Evelyn Glennie and Fred Frith ...nice improv of percussionists and photography...documentary style.

Hi there.

I just wanted to clarify my statement in my journal, since you seem to take this issue seriously.

When I first came to LJ, I had one icon, and I used that to symbolize my person in this interactive community. I got that image from my then-SO. I don't know where he came upon it, so I couldn't credit it. But neither was I meaning to profit from it.

After a few years, I decided to pony up the money to get a permanent account (and I see you have one as well). This opened up a vast amount of icon space, and I really didn't know what to do with it. But I finally started using other icons than just my first one. It really took me a while.

I have no photoshopping application at my disposal. I don't know how to make icons. I was truly happy when LJ introduced their icon creation tool, because that meant I could just use jpegs.

The demonic hello kitty icon was something I saw on LJ in a community. I didn't think many of my friends would have run into that icon, and so I thought I would add it to my repetoire. I did not ask to grab the image, no. But I'm not looking to profit from it.

The person who made the icon surely didn't contact the Hello Kitty company and ask if s/he could use its likeness for an LJ icon.

I'm not trying to take credit for the icon. It's just an image. I'm not trying to make money off of it. I don't understand what you are trying to get at here.

I'm perfectly willing to post this as a response to your comment in my LJ. At the same time, I wanted to be civil and explain it to you first. Your comment seemed to insinuate something about my character. I wanted you to have the context.

Sorry about slow to respond here...not been online even for business as much as I need to right now.

I too need the LJ tool, ditto the reasons. All the photography is mine. Photography is something I have done for quite awhile and I do wish to profit at it in the near future.

I see icons can get pretty involved.

Now, when I do not know a person in real life, I do not know what they mean when they say they "lifted" something. If they are playing, or what. I don't know what rules there are for icons, or if the person minds someone copying their icon, even if it is "not for profit"

As far as I know, it is copyright infringement if you copy a work, esp if no credit is given to the creator/writer etc, and it has not a lot to do with whether you are doing it to gain financial rewards or not. (though I am sure that would sure get folks a lot more interested in pursuing a lawsuit)

I am fairly new to LJ, I think, esp in the attitude of LJ. I have journaled since I was a child, it was private. I had no desire for it to be public. This whole thing is still weird to me.

Anyway, I 'don't' steal. I was raised to take that to levels most do not think about. Like, "buying stolen merchandise is stealing because you are helping provide the market and way for the thief to do the job" etc.

I think that is important to me, that the person who gives me something, actually has the ownership rights to give it.

I don't know if any of this makes any sense, it is just how I am wired.

Also, you are quite correct, the person who did the "hello kitty" thing might prefer not to be named because otherwise they could potentially be in trouble for using the image.

I have some questions about the vampire cat toy I photographed, as well as the cat with the feathers.

Now...once upon a time I knew a guy that had a site called "THX DIGITAL DUDE" and this site was AWESOME....AWESOME!!! This teenager had put it together. He was flash crazy to the point he was helping others learn it and giving tips to the books and programs to use, etc. No charge. No money involved anywhere.

One day this huge mega millions company socked him with a "cease and desist" order. He had to take down the website. On the plus side....he also got approached by Warner Brother's to do some work. So he never put up another great page...darn. If you look up flash and evaluations on flash, likely you will find him somewhere. Someday we will probably read about him.

All that to say, the money isn't the deal. Copyright is copyright. The owner decides if you get to use it or not, and how you can.

AND.....AND....I get to do research on copyrights, icons, what the rules are on using such things, etc.

This is just my understanding as of this moment. It is too bad there is no tone of voice here as the typed word can have geez...thousands of inflections(?) If I remember though, I was playful at the time with a bit of seriousness about "not stealing". No insult meant.

Like anything, there is good poetry, and there is good hip-hop music. Personal tastes differ, and the mainstream of both (greeting cards, for instance) suck ass.

I don't like much hip-hop, but the few songs I do like, I REALLY like. Same goes with poetry. Shakespeare has some wonderful work. I consider Jabberwocky to be brilliant.

And some work is better when the author/performer is performing their piece live. There's an authenticity that it othewise lacks.

You've hit the nail on the proverbial head. At the same time, he was railing on the culture, not just the music (although calling it "hip-hop culture" is colluding the two).
