While I don't know the facts in this situation--the article is very bare--my first response is: This is what happens when you start talking about "activist judges" and "unelected arms of government."

I don't think he was "unelected." But I do understand (and agree with) your point.

That's the common argument put forth by neoconservatives, that the judicial branch is an "unelected branch" of government. This is presumably because a good number of judges are appointed.

Neocons are logically impaired. Conservatives have appointed many of these so called activist judges.
