Because this ruling would have lead us down a slippery slope to where we could apply the death penalty to anything that violated our current sensibilities.
So, raping a child would warrant death, but raping a woman would not? What is the reasoning behind that?
I am against capital punishment. But, as long as it is in our system of jurisprudence, it should not be used if the death of the victim has not occurred. As Kennedy said, the punishment is not proportional to the crime.
