so, is it generally illegal to have unprotected sex if you know you're HIV positive? Or are they only talking about criminality here because of the fact that she's stated she's purposely setting out to transmit the disease? I wonder what the legality would be if someone did the same thing but never stated intent to transmit.

Yes, if one knows one is HIV positive and intentionally withholds that information from sex partners, that can be construed as intent to cause bodily harm. The fact that she stated plainly that this was her main intent means that she acted with malice aforethought--the equivalent of attempted murder in the first degree.

I'm not saying that a crime actually happened. I don't know. The Detroit police hasn't opened a case; they've just been fielding questions from people who honestly believe they had sex with the woman.

However, if evidence can be established, I'm sure she could be charged.
